Booking Conditions
1. Booking.
a. Please complete the booking form and pay your non-refundable deposit. Deposit amounts are as follows:
i. Self-guided itineraries of 9 nights or less are £150 per person.
ii. Self-guided itineraries of 10 nights or more are £200 per person.
iii. Guided holidays are £250 per person.
Deposits are non-refundable however should we be unable to process your booking i.e. due to places not being available on guided holidays, or accommodation already being fully booked for self-guided holidays we will refund your deposit payment to you.
Bookings can be made online at www.northwestwalks.co.uk. Upon receipt, we will process your booking and issue a booking confirmation within 3 to 5 working days.
b. The balance of your holiday must be paid in full no later than:
Self-guided holidays - 8 weeks before the start of your holiday.
Guided holidays - 10 weeks before the start of your holiday.
If the balance is not received by the due date, we may treat the booking as cancelled. If you book within the balance due period, you must pay the full holiday price at the time of booking.
c. We can accept payment by any of the following methods
i. Sterling cheque or bank draft made payable to Northwestwalks.
ii. Bank transfer.
iii. Debit or Credit card online.
iv. PayPal online.
Payments are not accepted in foreign currency.
2. Trust Fund.
Northwestwalks complies with Tour Operator legislation. A Trust Fund operates with the purpose of serving the business and protecting your payments, this means that in the unlikely event that we become insolvent your money is protected and will be refunded to you in full.
3. Cancellation/Alteration/Transfer.
All cancellations, alterations or transfer requests must be in writing, letter or Fax, and be signed by the person who signed the booking form. Your date of cancellation, alteration or transfer is the date when we receive the written notification.
a. Cancellation by you
In the event of you cancelling the holiday of any person or persons on the booking form, we will apply the following cancellation charges for each such person:
i. Self-guided holidays:
More than 56 days before the holiday start date - Deposit only.
56-31 days before the holiday start date - 50% of the total price of your holiday.
30-15 days before the holiday start date - 80% of the total price of your holiday.
14-0 days before holiday start date - 100% of the total price of your holiday.
Cancellation and re-booking for alternative dates will be subject to the cancellation charges above.
ii. Guided holidays:
More than 70 days before the holiday start date - Deposit only.
70-31 days before the holiday start date - 50% of the total price of your holiday.
30-15 days before the holiday start date - 80% of the total price of your holiday.
14-0 days before holiday start date - 100% of the total price of your holiday.
In addition to the above charges, for self-guided and guided holidays, it may be necessary to add under occupancy or single room supplements to other members of your party where member(s) of your party cancel. Any group discount may also be forfeit.
b. Alterations by you
If you wish to alter your booking prior to your final balance payment date we will do the utmost to accommodate your request, subject to a £25 per person administration charge plus any additional costs we may incur. Any alterations after your balance payment due date will also be subject to the cancellation charges specified in 3a.
c. Guided holiday transfers
If you wish to transfer your booking prior to your final balance payment due date, we will do the utmost to accommodate your request, subject to a £100 per person administration charge plus any additional costs we may incur. Any transfers after your balance payment due date will also be subject to the cancellation charges specified in 3a.
d. Cancellation and alterations by us
Whilst we always endeavour to avoid changes and cancellations we must reserve the right to do so. Very occasionally we have to change an accommodation booking and if we do so we will notify you as soon as possible. We will do everything in our power not to cancel your holiday. However in the unlikely event that we do have to cancel, your deposit and balance will be refunded to you, but we will not have any further liability to you.
4. Personal holiday insurance.
We strongly recommend you take out Personal holiday insurance to cover illness, injury, personal belongings and cancellation - cancellation fees are implemented in all cases, so we recommend that you are fully covered by a travel insurance policy to cover non-returnable costs should you have to cancel your trip due to unexpected circumstances.
5. Our responsibility.
We will accept responsibility for the negligent acts and/or omissions by us, our employees or agents, our suppliers and sub contractors and their servants or agents for claims resulting in death, bodily injury or illness of a client. We cannot accept responsibility for loss or damage to property or injury or death resulting from Force Majeure or circumstances beyond our control. We cannot accept responsibility for any service which does not form part of our advertised holiday e.g. any additional services or facilities which your hotel or any other supplier provides for you. Our liability to any one person shall not exceed the cost of that persons holiday.
Guided holidays - Clients agree to abide by the decisions of the Guide. We reserve the right to change or cancel walks or itineraries in the light of bad weather or hazardous conditions or other safety reasons.
6. Your responsibility
As participants in hill walking/trekking/hiking, etc you are aware, or reminded, that these activities have a danger of personal injury or death and that you accept these risks and are responsible for your own actions and involvement. Before embarking on your holiday you should be physically fit enough to cope with the holiday as advertised, the distances and terrain, and be suitably equipped and clothed to meet your challenge.
7. Conduct.
We reserve the right to end your holiday if your conduct or that of any member of your party in our opinion causes undue distress, damage, annoyance to other guests, employees, accommodation or to any third party. Cancellation charges of 100% will apply in these circumstances. In the case of damage you will be liable for any damage caused, together with any legal costs we incur in pursuing the claim.
8. Complaint.
In the event of a complaint or experiencing a problem please contact us immediately so that steps can be taken to try and rectify the problem. We must be given the opportunity to rectify a complaint at the time otherwise we will not accept responsibility at a later date. Should it not be possible to resolve your complaint immediately you should write to us, giving full details, within 14 days of the holiday s conclusion.
9. Persons under the age of 18.
Persons under the age of 18 must be accompanied by a Parent or Guardian.
10. Jurisdiction.
This contract is made on the terms of these booking conditions which are governed by English Law and clients shall submit to the jurisdiction of the English Courts.
